The Energy Regulatory Office (ERO) was established as of 1 January 2001 pursuant to Act No. 458/2000 of 28 November 2000 on Business Conditions and Public Administration in the Energy Sector and on Amendment to other Laws (the Energy Act).

Under Section 2, Subsection 1, Item 11 of Act No. 2/1969, as amended (the Competency Act), ERO is classified as "another central authority of state administration". ERO's terms of reference include promotion of competition and protection of consumer interests in the areas of the energy sector in which competition is not feasible, the purpose being to satisfy all reasonable requirements for energy supply.

ERO is based in Jihlava and the subsidiary office is in Prague. The number of employees in 2002 was 78 people.

ERO has three Sections: the ERO Office Section, the Licensing Section, and the Regulatory Section.
